This policy covers our collection and use of your personal data that we gather when you access our Services and/or Content. We explain what information we gather, why we gather it and the choices you have regarding your personal data.

As customers, you do not have any legal obligation to provide any information to us. However, we require certain information from you to operate properly, including completing a transaction on your behalf. Login credentials (email and username) enable us to personalize and improve our services. You hereby agree and acknowledge that any information you do provide to us is provided at your own free will, for the purposes mentioned in this Privacy Policy and that we may keep such information in a database(s) which will be registered and kept in accordance with applicable laws and regulations.

We ask for and collect the following personal information about you when you use our Platform. This information is necessary for the adequate performance of the contract between you and us and to allow us to comply with our legal obligations. Without it, we may not be able to provide you with access to the Platform.

1. Account information. When you sign up for an Account, we require certain information such as your first name, last name, phone number, email address, date of birth, and a profile picture.
2. Payment information. To process any payments on the Platform (such as placing an order or booking any of the Services), we may require you to provide certain financial information (like credit card information) in order to facilitate the processing of payments. (payment information is held by our payment processors rather than us).
3. Communications with Shayv. When you communicate with Shayv or use the Platform to communicate preferences etc. we collect information about your communication and any information you choose to provide.
4. Additional profile information. You may choose to provide additional information as part of your Shayv profile (such as gender, preferred language(s), and a personal description). Some of this information as indicated in your Account settings is part of your public profile page and will be publicly visible to Shayv third party service providers.
5. Personal interests contacts, and other Information. You may choose to provide the address of your current work, relatives, or other points of interest manually to access certain features of the Platform, like inviting them to use Shayv.
6. Other information. You may otherwise choose to provide us with information when you fill in a form, update or add information to your Account, respond to surveys, participate in promotions, communicate with our customer care team, share your experience or reviews with us or use other features of the Platform.

1. Usage information. We collect information about your interactions with the Shayv Platform such as the pages or content you view, orders you have placed, and other actions on the Platform.
2. Geo-location information: When you use certain features of the Shayv Platform, we may collect information about your precise or approximate location as determined through data such as your IP address or mobile device’s GPS to offer you an improved user experience. Most mobile devices allow you to control or disable the use of location services for applications in the device’s settings menu. Shayv Platform may also collect this information even when you are not using the application if this connection is enabled through your settings or device permissions.
3. Log data and device information. We automatically collect log data and device information when you access and use the Platform. That information includes, among other things, details about how you have used the Platform (including if you clicked on links to third party applications), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, cookie data, and the pages you’ve viewed or engaged with before or after using the Platform.
4. Cookies and similar technologies. We use cookies and other similar technologies when you use our platform, use our mobile app, or engage with our online ads or email communications. We may collect certain information by automated means using technologies such as cookies, web beacons, pixels, browser analysis tools, server logs, and mobile identifiers. In many cases, the information we collect using cookies and other tools is only used in a non- identifiable manner and without reference to personal information. For example, we may use information we collect to better understand website traffic patterns and to optimize our user experience. In some cases, we associate the information we collect using cookies and other technology with your personal information. Our business or technology partners may also use these tracking technologies on the Platform or engage others to track your behavior on our behalf.
5. Pixels and SDKs. Third parties, including Facebook, may use cookies, web beacons, and other storage technologies to collect or receive information from our websites and elsewhere on the internet and use that information to provide measurement services and targeted ads. For third party apps, including Facebook, may collect or receive information from your app and other apps and use that information to provide measurement services and targeted ads. Users can opt-out of the collection and use of information for ad targeting by updating their Facebook account ad settings and by contacting our customer service with a description of their request and validation information.
6. (Do Not Track) signals. While you may disable the usage of cookies through your browser settings, the Shayv Platform currently does not respond to a “Do Not Track” signal in the HTTP header from your browser or mobile application due to lack of standardization regarding how that signal should be interpreted.
7. Payment transaction information. Shayv Platform collects information related to your payment transactions through the Shayv Platform, including the payment instrument used, date and time, payment amount, payment instrument expiration date and billing postcode, email address, credit or debit card information, your address and other related transaction details. This information is necessary for the adequate performance of the contract between you and Shayv Platform and to allow the provision of the payment services.

1. Shayv Platform may collect information, including personal information, that others provide about you when they use the Platform and the payment services, or obtain information from other sources and combine that with information we collect through the Platform and the payment services. We do not control, supervise or respond for how the third parties providing your information process your personal information, and any information request regarding the disclosure of your personal information to us should be directed to such third parties.
2. Third Party Services. If you link, connect, or login to your Account with a third party service (e.g. Google, or Facebook), the third party service may send us information such as your registration, friends list, and profile information from that service. This information varies and is controlled by that service or as authorized by you via your privacy settings at that service.
3. Referrals. If you are invited to Shayv Platform or have been referred to use our Services, the person who invited you may submit personal information about you such as your email address or other contact information.
4. Other Sources. To the extent permitted by applicable law, we may receive additional information about you, such as demographic data or information to help detect fraud and safety issues, from third party service providers and/or partners, and combine it with information we have about you. For example, we may receive background check results (with your consent where required) or fraud warnings from service providers like identity verification services for our fraud prevention and risk assessment efforts. We may receive information about you and your activities on and off the Platform through partnerships, or about your experiences and interactions from our partner ad networks.

We use the information we collect in order to:

1. − Operate and improve the Services and to display Content.
2. − Allow you to take full advantage of the Services.
3. − Allow you to order products on the Platform (where applicable)
4. − Process or facilitate payments through third party payment processors (where applicable)
5. − Recommend relevant products, and make it easier for you to track products you are interested in.
6. − Offer you a personalized experience of the Services offered on the Shayv Platforms.
7. − Communicate with you about your bookings and provide customer service, technical assistance and collect feedback.
8. − Communicate with you about products, sale reminders, services and promotional offers.
9. − Administer your account if you have one and update our records.
10. − Enable third-party service providers and contractors to carry out technical, logistical or other functions on our behalf.
11. − Conduct research, troubleshoot problems, and detect and protect against error, abuse of the Services, fraud or other criminal activity.
12. − Control risks and comply with laws, regulations and with other legal process and law enforcement requirements.
13. − Produce aggregated statistical reports (provided that the reports do not identify customers).

We take care to maintain appropriate safeguards and security features to protect the integrity and privacy of the information you provide us with and to try to prevent unauthorized access to it. We encrypt your information to protect it from unauthorized use, and we use pseudonymization, information access controls, and firewalls.

All information you provide to us is hosted and stored on Amazon Web Services cloud-based services in Ireland which is also in compliant with ISO27001 standard. If you are not satisfied with the levels of security offered by our cloud provider, you should restrict the nature and amount of information which you include in your log data or not use the Services. Any payment transactions will be encrypted using Secure Socket Layer (SSL) technology.

If you choose to create an account with Shayv (a “Shayv Account”), the information in your Shayv Account is protected by a password for your privacy and security. You need to ensure that there is no unauthorized access to your account and information by selecting and protecting your password appropriately and limiting access to your computer and browser by signing off after you have finished accessing your account.

You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. Shayv encourages you to use “strong” passwords (passwords that use a combination of upper- and lower- case letters, numbers and symbols) with your account. Shayv cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements. The transmission of information via the Internet is not completely secure and we cannot guarantee the security of your data transmitted to the Services. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time. Any transmission of data is at your own risk.

Subject to any legal obligations to keep your information longer, we store the data you provide to us for as long as is necessary to provide the Services to you (and if you have a Shayv Account, for as long as you have a Shayv Account), or until you ask us to delete it, whichever comes first. After a request from a User to delete any data, a process will begin that permanently deletes the relevant data. Once begun, this process cannot be reversed, and data will be permanently deleted. Any data which is not deleted shall be kept in an anonymized manner. Shayv collects and retains usage data, other metadata and statistical information about the use of the Services in an aggregated and anonymized format

We process your information where we have a legal basis for doing so.

1. − Necessary for our legitimate interest. Our legitimate interests include: Improving the Shayv Sites and Services and offering you a personalized experience. Ensuring that our marketing communications, advertising and recommendations are relevant to you. Understanding customer usage of the Services. Ensuring the Services are managed correctly.
2. − Necessary for the performance of our contract with you. For example, in order to register and manage your Shayv Account, we collect your email address, password and any other additional details you wish to add to your account.
3. − Based on your consent. For example, where you provide us with marketing consents in order to send you information about products that may be of interest to you. Your consent may be withdrawn at any time by contacting us.
4. − Necessary to comply with relevant legal obligations. For example, to make mandatory disclosures to law enforcement.

Shayv reserves the right to change this Policy from time to time. Use of information we collect now is subject to the Policy in effect at the time such information is used.

If we make substantial changes in the way we use personal data, we will notify you by posting an announcement on the Services or sending you an email. Otherwise, all other changes to this Notice are effective as of the stated “Last Revised” date.
